  • General Processing

The MARS platform processes personal data provided directly by you when registering on our website, for carrying out operations related to the opened account and for purchasing the offered services. The processing of your personal data is necessary for the fulfillment of orders placed online. In case of refusal regarding the processing of personal data, MANAGEMENT APPLICATION FOR ROUTE STRATEGY SRL is unable to honor the order.

  • Communication and Legal Obligations

Also, the processing of your personal data is necessary to communicate with you regarding the honoring of the services purchased on the MARS platform. At the same time, we process your personal data to fulfill legal obligations (e.g., for accounting registration of your orders).

IV. Services Provided through the Application(s)/Website(s)

The services that MARS provides consist of:

  • Access to and use of MARS mobile applications and/or websites that allow you to request and benefit from Third-Party Services and/or Services Provided by MARS.
  • Access to the site is done by https://marsapp.ai or by MARS mobile App
  • Mobile App Usage by Truck Drivers
  • The use of the Services requires installation of the App and registration of a user account ("Account"). In order to use the app, the mobile number of the driver will be linked to their Account. We add the mobile number of the driver în Our database exclusively to allow access to the MARS mobile applications
  • We require drivers to provide their phone number for the purpose of secure authentication and account verification within the app.
  • We may update the App from time to time in order to provide you with the best possible service. The services available via the App are only accessible with an internet connection. There are no specific technical requirements for the internet connection, however, the quality of the service may be affected by the internet speed. The App is available on Android and Apple devices in accordance with the latest software update
  • In case of any defaults in the App, We endeavor to correct them as soon as possible, but You acknowledge that the functionality of the App may be restricted due to occasional technical errors and We are not able to guarantee unlimited faultless functioning of the App at all times. We accept no liability for any losses incurred as a consequence of the App not functioning or not being usable in the desired manner.
  • In order to provide you with the full services we will need to get access to Camera and Location data.
  • Camera Access and Document Uploads
  • The MARS mobile app requires access to the device’s camera to allow drivers to upload photos of critical documents as proof of delivery. These images may include names, signed receipts, bills of lading, or other relevant paperwork. We understand the sensitive nature of these documents and implement strict security measures to protect them.
  • Location Data
  • In order to provide efficient delivery services and ensure the safety of both drivers and cargo, our mobile application processes location data from truck drivers' devices. This includes real-time location tracking from the start of a trip until its completion. This data is essential for dispatching, route optimization, estimated arrival times, and verifying delivery completion
  • Background Location Services
  • During an ongoing trip, continuous location services are required, even when the app is running in the background. This ensures accurate tracking, timely updates, and enhanced safety features.
  • Consent
  • We will obtain explicit consent from truck drivers before accessing their device's camera or collecting location data through the mobile app. This consent will be clearly communicated and can be withdrawn at any time.

V. Automated Processing

In situations of automated processing of personal data, MANAGEMENT APPLICATION FOR ROUTE STRATEGY SRL guarantees your right to obtain human intervention from us, to express your point of view and to contest the decision by sending a request in this regard to the email address office@marsapp.ai

VI. Recipients or Categories of Recipients of Personal Data

Your personal data may be transmitted to:

  • Our employees, collaborators, delegations;
  • Authorities, public institutions of the Romanian state.
  • 3rd party users enrolled in our platform to facilitate communication and to provide their services

VII. Categories of Data Collected and Processed

In order to provide the services, we collect and process the following categories of data:

  • For legal entities: name, surname, signature, email address, telephone number of the legal representative of the legal entity or of the contact person designated by its representative.

VIII. Transfer of Personal Data to Third Countries

Within the framework of the collaboration relationship with you, MANAGEMENT APPLICATION FOR ROUTE STRATEGY SRL could be put in the situation of transferring some of the data provided by you (AWB code, legal representative contact details, etc.) to third countries (outside the European Economic Area). In this case, MANAGEMENT APPLICATION FOR ROUTE STRATEGY SRL will ensure either that the transfer is made to a country that ensures an adequate level of protection, or it will take additional appropriate data protection guarantees, such as the implementation of standard contractual clauses approved at European level or mandatory corporate rules.

IX. Duration of Storage of Personal Data

Your personal data is processed for as long as the User has an active account opened on the MARS platform, as well as after the termination of the contractual relationship for a period of 3 years and 8 months, a period determined by the general limitation period (3 years) to which is added 8 months in which we can receive any procedural documents from the court and/or public authorities or institutions.

X. Your Rights as a Data Subject

As a data subject, you have the following rights:

XI. Exercising Your Rights

Each of the above rights can be exercised by sending a written, signed and dated request to the headquarters of MANAGEMENT APPLICATION FOR ROUTE STRATEGY SRL in Timisoara, Str. Simion Barnutiu Nr. 34 or to the email address office@marsapp.ai.

In the situation where you consider that your rights are not respected, you can contact the data protection officer at the above address or you can file a complaint with the National Supervisory Authority for Personal Data Processing (ANSPDCP).
